ABUSE OF RIGHT: CONCEPT, SIGNS, GENERAL CHARACTERISTICS

The article is devoted to one of the most disputable categories of jurisprudence – abuse of rights. Modern civil legislation contains many of the assessment law. Interpretation and specification of evaluative concepts is a challenging intellectual process. Abuse of right is a consequence of the process of interpretation of appraisal standards. The law does not allow the exercise of civil rights with the intent to harm another person, as well as abuse of rights in any form, including in the form of circumvention of the law. The author regards as the already known issues with the application of the principle of the inadmissibility of abuse of the right, so new in connection with the amendments to the Civil code of the Russian Federation. In particular the principle of good faith is investigated as a fundamental principle for civil rights. The article is devoted to the question on the essence and the legal nature of circumvention of the law, as well as the notion of circumvention of the law with unlawful purpose as a form of abuse of right. On the basis of the study presents the author's notion of circumvention of the right. The authors have made a conclusion that the correct interpretation of the categories of "subjective property law and protected by law interest" is the key to understanding the notion of abuse of right. The conscientiousness of participants of civil relations, as well as the intelligence is the proper limits of lawful behavior of the subject civil relationship, the breach of which allows detecting the signs of abuse of subjective civil law

STRUCTURE OF PROPAGANDA MACHINE ANTI-BOLSHEVIK MOVEMENT IN SOUTHERN RUSSIA IN 1919

The article is devoted to the study of the structure of the apparatus of propaganda of the Volunteer army and Armed forces of South Russia under the command of General M. V. Alekseev, as well as the changes implemented in this structure by generals A. I. Denikin and P. N. Wrangell. We have highlighted the high importance of an effective propaganda mechanism during the civil war and iIndicated the reasons why the propaganda machine on the "White South" lost the efficiency of similar structures of the Bolsheviks. We considered such reasons as the absence in the Volunteer army powerful single ideology, as the basis for further indoctrination, the Bolsheviks significant advantage in material and technical equipment and production capacity, and advantage in time, as the propaganda machine of the Bolsheviks began to form several years before the outbreak of the civil war. The article reveals the formation process of the news propaganda of the Department of diplomatic division and its subsequent reformation in the Publicity Agency (Oswag) of the Chairman of a Special meeting. We have also touched upon the dissolution of Osweg at P. N. Wrangel and the establishment of a number of departments executing its functions. It is concluded, that the changes in the structure of the propaganda of anti-Bolshevik movement in South Russia, were excessively complicated and mostly formal in nature, they did not solve existing problems, but only created new ones. It is noted, that the main task of all transformations in the apparatus of propaganda, i.e. to overcome the significant advantages of the propagandists of Bolshevism, was not achieved as a result of the considered structural reforms

AXIOLOGICAL MODEL OF INSTRUCTIONAL DESIGN

The article presents instructional design as a new approach to the issue of developing value-oriented worldview. Scientific research and analysis led the author to summarize instructional design theory, broaden the definition of instructional design and apply it to instruction and learning in a new manner. The goal to build a pattern of instruction aimed at developing learners’ value-oriented worldview required the author to study the existing instructional design model, to analyse and generalize a number of monographs and articles devoted to the problem of building value systems and value orientations, and finally to investigate and apply the new knowledge to real life in the form of experiment. The work conducted brought the author to axiological model of instructional design, which consists of three dimensions: a linear sequence of the events from designing the instructional material to independent learning activities, interaction between a teacher and a learner, pace of learning and design. The article touches upon every dimension, level and stage of the model, describes and defines the procedures that take place on each of them, as well as suggests a possible way to visualize the model in a form of a sketch. The author also points out the advantages of using instructional design as an efficient and smart tool to organize learning and justifies the use of the new instructional design model in XXI century

NUMERICAL RESEARCH TECHNIQUES OF MAGNETIC FIELDS GENERATED BY INDUCTION CURRENTS IN A MASSIVE CONDUCTOR

We consider the technology of application of numerical methods in the educational process in physics on the example of a study of the magnetic field induced by induction currents in a cylindrical conductor in a quasi-stationary magnetic field. Here is given the numerical calculation of the real and imaginary parts of the Bessel functions of complex argument. The listing of the program of drawing the graphs of the radial dependence of the amplitude and phase shift of the inductive currents field is cited. The graphs of the dependence of the parameters of the field on the radial coordinate for different values of the control parameter are drawn. The control parameter z is proportional to the frequency of the external magnetic field, the conductivity of the material and the square of the radius of the cylinder. When z is less than 1, the amplitude of the field of currents increases in proportion to z, and decreases quadratically with the increasing radial coordinate h. For a larger z the amplitude and the phase shift relative to the external field change nonlinearly with the increase of h. It is concluded that there exists a significant difference between the inductive currents field and the total field in the cylinder equal to the sum of the external field and the currents field. The nonlinear connection between these fields is explained. The use of this method in the educational process of pedagogical (physics) and technical institutes of higher education is recommended

INDIVIDUAL PSYCHOLOGICAL CHARACTERISTICS OF RAILWAYS OPERATORS OF DIFFERENT AGE GROUPS

The article presents the results of the study of some individual psychological characteristics of the drivers of rail transport in the age groups 25–34 and 35–45 years. We have identified a number of differences between the two age groups associated with both features individually-psychological sphere, and in the psycho-physiological features. Features of age-related psychological differences can be explained by the age characteristics of the representatives of each group; psycho-physiological features of age differences may reflect developed in the course of a long professional activity features. We have also developed adaptive strategies, consciously or unconsciously selected during the long-running monotonous activities and in small social groups (teams of drivers) allow, on the one hand, higher quality performance of their professional duties, on the other — to avoid the harmful effects of stressful situations at work. It can be assumed that the composition of drivers age group 35– 45 years is the result of natural selection, when those who did not cope with this type of activity is simply dismissed or transferred to other kinds of professions

THE ANALYSIS OF POLITICAL CONSCIOUSNESS AND CIVIL ACTIVITY OF MODERN STUDENTS IN THE CONDITIONS OF REALIZATION OF ACTIONS OF THE STATE YOUTH POLICY

The article is devoted to the vital problem of studying the contemporary condition of political consciousness level and citizen activism among students in Russia in the context of the events realization within the youth policy state programs. Main problems, which are being addressed by various federal target programs in this field (including inconformity of approaches to life, values and behavior models of youth with the country demands; lack of interest among youth in sociopolitical life of society, etc.), are introduced in the paper. Increased focus is put on analysis of youth as a main party of civil society formation and transformation processes. Based on the completed sociological survey among students of Kuban State Agrarian University, the level of awareness of respondents in the field of current international and national political processes and level of their influence on politics, author has identified attitude of the survey participants to political sphere, political leaders, actions of political power and socio-political organizations. Besides, the obtained survey results have allowed to analyze the degree of democratic principles implementation in Russia and its role in the modern world, as well as to identify the most urgent problems affecting Russian society in general and respondents in particular. On the basis of the survey data, the author makes a conclusion about immaturity of political consciousness and catastrophically low level of citizen activism among students which decelerates the process of civil society development

The development of information and communication technologies of the socio-political sphere acquires new quality and presentation and implementation of political action from the federal level to the municipalities. In this connection it is necessary to consider and to conceptualize the notion of "network of local politics", highlight it institutionalized (eg, local government) and non institutionalized actors (such as local community network), describe their communication channels, and methods and tools used. All this will help to build a theoretical model of the "network of local politics" allows analyzing social and political processes at the municipal level. The need for this kind of analysis is connected with the diversification of the local authorities in various regions of Russia and uneven socio-economic development of regions due to various socio-cultural characteristics, geographical and other contexts
