USING EXPERTISE IN THE INVESTIGATION OF UNLAWFUL USE OF A TRADEMARK

The author of the article explores the order of the using the special knowledge in the investigation of the unlawful use of the trademark, the forms of the using special knowledge. It is impossible to carry out the investigation of the illegal use of a trademark just as other economic crimes without the use of the special knowledge. The main task which is solved by means of the expert research is finding of the use on the certain products of the alien trademark, this means there are mismatches of the product quality with the quality of the claimed trademark. No matter in what forms the special knowledge is used (the expertise, the professional judgment or the debriefing of the knowledgeable person), it should be used at the time of the inspection reports of the illegal use of the trademark. The author has examined the procedures of the competent person, who invited as a specialist during the inspection of the seizure, counterfeit products; he showed the sequencing of the action for the implementation of the examination by a specialist. During the inspection the expert must assist the investigator (inquirer) in the identifying of those attributes that point to counterfeit products. The characteristic signs of the counterfeit products were investigated. It is highlighted the need for special knowledge in the field of merchandising, for the conducting of the merchandising researches in the investigation of the unlawful use of the trademark, is also needed for the appointment and other examinations such as patents; computer, technical and forensic examination of documents

Diagnosis by PCR-RFLP (polymerase chain reaction – polymorphism of the lengths of restriction fragments) is the standard analysis of point mutations for the diagnosis of allelic polymorphism of candidate genes related with productive qualities of farm animals. THE ESSENCE OF THE SHADOW ECONOMY AND THE PECULIARITIES OF ITS DEVELOPMENT

This article contains the answer for the question about the "shadow" sector of the national economy, there is the author's interpretation of "shadow economy" as a self-organizing system, which develops itself according to the main economic principles and situates in harmonious coexistence with the economic environment. We have identified the main causes of the appearance of shadow structures, stages (birth, development, maturity, decline and death), their characteristics and offered the basic directions for fight with the shadow economy. This research was illustrated with drawings and analytical tables. The author reveals the essence of the system of national accounts, as a system of indicators which were recorded in the form of accounts that reflect the different sides of the reproduction processes in the economy, it identified the main indicators and schematically illustrates the relationship of these indicators. We have estimated the size of the shadow economy in different countries, identified factors that help to the development of shadow structures, including the imbalance of demand and supply, which is caused the deficit of goods and services. The author presents the main trends of spreading the shadow economic activities (financial, economic, legal, administrative, social and political) and the direction of fighting against the shadow economy, with the help of mass supporting this struggle in society

Long time in Russia we have a paradox when the law rules are accepted, reconsidered with the different level of the knowledge intensity and the effect for the social development, but the practice works with the essential derogation from the observance of the established legal regulations. ACTIVITY IN OF R. POROKHNYA - THE FIRST TROOP ARCHPRIEST OF THE BLACK SEA COSSACKS IN THE KUBAN REGION

In modern conditions of personification of history it becomes especially important to study works of famous figures of the Black Sea clergy. Roman Porokhnya was one of such priests. His personality never became an object of special research that was connected with scarcity of sources. In this article an attempt to observe his life and activity as the first army archpriest of the Black Sea Cossacks on the Kuban earth was made for the first time, the archival documents which hadn’t been studied before were introduced into scientific circulation. A lot of place in article is allocated for reconstruction of the historical past of the Black Sea Cossacks of the end of XVIII – beginning of the XIX centuries. In this work, on the basis of the analysis of the works of R. Porokhnya we have shown a special place of a role of the priest in the life of the Black Sea Cossacks. In the article his educational activity, his works connected with the beginning of church construction in uninhabited Kuban lands were considered in detail. A lot of place here was taken by the history of church relics of the Black Sea Cossacks, the important role of Roman Porochnya in their preservation is shown. Also the problem connected with formation of local clergy doesn't remain unaddressed. In the article the main difficulties of it are shown, local specifics were discussed. Against the background of the description of the socio-economic and political development of the Kuban we presented a historical portrait of R. Porokhnya and we showed the role of a well-known personality in the history of the Kuban

Conducted in our country reforms require active participation in their realization of all citizens. The development of the economic components of the state, will allow not only to strengthen the defense potential of the country, but also to raise the quality of life of the population. To solve this problem the country needs competent specialists, real, educated professionals, masters of their craft. The most important task of each University is to prepare such graduates. Training at the University is done not only through training and education, but also in the process of independent activity of students. Independent work is the activity performed by the students of the University without direct contact with the teacher or teacher-driven mediated through specific training materials; it is an integral, compulsory element of the learning process, providing primarily individual work of students in accordance with the setting of teacher or textbook curricula. In the modern didactics, independent work of students is, on the one hand, a kind of educational work carried out without direct intervention, but under the guidance of a teacher, and as a means of engaging students in independent cognitive activity, the formation methods of the organization of such activities. The effect from independent work of students can be obtained only when it is organized and implemented in the educational process as a holistic system that runs through all the stages of learning of students in high school. THE EFFECT OF TREATMENT OF GRAPE CUTTINGS WITH ELECTROMAGNETIC FIELD ON THEIR REGENERATIVE SKILLS

The article presents the results of studies on the effect of processing varieties of grape cuttings of Pervenets Magaracha using alternating electromagnetic field on their regenerative skills. Processing the cuttings with alternating electromagnetic field was carried out using an induction coil for 5,10,15 and 20 min. As a control option, the cuttings were soaked in water, as a standard option – the cuttings were soaked for 24 hours in a 0.01% solution of IAA. Rooting was performed in vessels with water at optimum temperature conditions. It was found, that the use of IAA for the first time led to the inhibition of blooming buds. EMF treatment of cuttings with each exposure has a stimulating effect on this indicator. Application of EMF exposures in the 5 to 15 minutes resulted in a significant increase in the length of shoots, compared to the control variant and the option to IAA. Processing cuttings with EMF exposures at 5,15 and 20 minutes resulted in a significant increase in rooting compared with the control. Maximum rooting was obtained at an exposure of 15 minutes. It was the same as in the version with a standard rooting stimulant - IAA. However, the highest yield of cuttings with 3 roots and ended up in a version with a 20-minute exposure. Maximum number was noted on the heel of the roots cuttings option with IAA. Treatment of cuttings with EMF exposure 5, 10 and 20 minutes, has also led to a significant increasing of this indicator, respectively, 45.5; 22.7 and 79.5%. The maximum increase in the number of roots was obtained in the variant with exposure 20 minutes. Thus, this option should be considered as the best one
